Refugee protection

The following sections contain information on the most important international treaties and agreements of which Libya is signatory, as well as national legislation relevant to the protection of refugees.

Libya has not ratified and is not a party to the 1951 Convention relating to the Status of Refugees or its Protocol. It has however ratified the 1969 Convention governing the Specific Aspects of Refugee Problems in Africa (OAU Convention), which adopts the same definition of a refugee as the 1951 Convention and its 1967 Protocol.

Libya has yet to implement the OAU Convention through the adoption of asylum-related legislation or procedures. Furtermore, Libyan law considers asylum-seekers and refugees as illegal migrants and arbitrary detention in lifethreatening conditions is widespread, with frequent allegations of torture, or other forms of cruel, inhuman or degrading treatment.

The IOCEA has worked with refugees and migrants in Libya since 2011. They work in partnership with other international organisations, the UNHCR and the Danish Refugee Council to implement jointly their programme in Libya. The IOCEA works to promote the introduction of legislation safeguarding the rights of refugees and asylum seekers; which they have assisted in drafting. They also provide legal advice and representation for asylum seekers and refugees in Libya.

Due to the high rates of discrimination, exclusion and violence faced by women in Libya, the NGOWG advocates for the Security Council to continue supporting the United Nations Support Mission in Libya (UNSMIL) to include women as full and equal partners in supporting the transition of power to the Government of National Accord, which has struggled to establish legitimacy and control.

The International Organization for Migration is the leading inter-governmental organization promoting humane and orderly migration for the benefit of all, with a presence in over 100 countries, and supporting 175 member states to improve migration management. In 2021, IOM´s work on the mobility dimensions of crisis reached 31.7 million persons (including internally displaced persons, refugees and migrants) and host community members.

The Organization works to help ensure the orderly and humane management of migration, to promote international cooperation on migration issues, to assist in the search for practical solutions to migration problems and to provide humanitarian assistance to migrants in need, be they refugees, displaced persons or other uprooted people. The IOM Constitution gives explicit recognition to the link between migration and economic, social and cultural development, as well as to the right of freedom of movement of persons.
