Refugee protection

The following sections contain information on the most important international treaties and agreements of which Cambodia is signatory, as well as national legislation relevant to the protection of refugees.

Cambodia is one of only two Southeast Asian nations to be signatories to the 1951 Convention Relating to the Status of Refugees and the 1967 Protocol. Cambodia, however, is not a Party to the UN Conventions on Stateless, including the 1954 Convention Relating to the Status of Stateless Persons and the 1961 Convention on the Reduction of Statelessness.

At the national level, in 2009 Cambodia’s Sub-Decree #224 established the “Procedure for Recognition as a Refugee or Providing Asylum Rights to Foreigners in the Kingdom of Cambodia” which ensures the respect of the rights of refugees in line with the 1951 Refugee Convention. Sub-Decree #224 further adopts a definition of a refugee that is generally in line with Article 1A(2) of the 1951 Refugee Convention.

JRS Cambodia provides legal and social assistance to asylum seekers and refugees currently living in Cambodia. JRS’s legal assistance comes in the form of legal representation and advocacy throughout the refugee status determination (RSD) process at the Royal Cambodian Government. JRS social works further provide care through the provision of suitable accommodation and access to education. JRS provides additional advocacy and human rights assistance in the area of land mines and cluster munitions.

KKHRA provides legal aid and services to refugees, ensuring representation for refugees seeking asylum, as well as those in detention or facing criminal charges. KKHRA provides both general information as well as preparation for status determination interviews and UNHCR representation. KKHRA will make referrals to other NGOs where appropriate, including for psychosocial support services. KKHRA is a member of the larger Asia Pacific Refugee Rights Network.

MIRO seeks to strengthen vulnerable minorities in Cambodia including the Khmer Krom who have escaped from southern Vietnam. MIRO strives to continuously promote and defend human rights and social and economic prosperity through the realization of empowerment initiatives, legal aid, capacity building, and advocacy. MIRO was founded by a group of Cambodian experts who have years of experience on minority rights issues.
